Narrative Response Essay One way that I can relate to Emmerson's teaching of individualism is dealing with standardized teaching in K-12 schools, and how it affected myself as well as my fellow students and how we were treated like numbers instead of people as well as just another problem that the teache r s had to deal with 5 times a week , 6 hours a day. Because of this, students were not taught in detail and the number of graduates decreased and the number of students increased from the lack of course knowledge. Standardized testing is said to be the best way for students to learn and develop, but the people in which it effects say otherwise. In my experiences, there were two groups of students in the school, the first that was placed in AP classes and the second which were put in "regular" classes, the kids who were placed in the AP program got good grades and were taught how someone expects students should be taught in high school courses. Then there was my group , the average student where the teachers didn't care about the students and simply gave us busy work and said good luck! This style of "teaching" caused many students grades to go down including mine. So, from there I decided that it would be on me to find a way to be able to be successful in my classes with some outside help that wasn't from the school district. When my parents saw that my grades had gone down during the course of only a few weeks they started to ask questions and I told them in ful l what was going on . Together we developed a plan on how to combat this problem s tarting with going to the teachers and asking about their syllabus and how they run the class . My parents asked the teachers about their syllabus but it seemed that only two of my teachers even knew of the concept of a syllabus and those were the classes in which I had been doing good in. we then proceeded to make appointments and talk with the rest of my teachers where we kept running into the same problem over and over again , T he lack of a syllabus. The teachers plan was simply to put out the required information that they needed to cover in the semester and nothing more but they didn't exactly know how they were going to do it but were confident that they could do it. After my parents and I went through about seven different parent teacher conferences which had the same outcome we decided to go on e step higher and request to talk with the principle of the school who in the end never agreed to have a conference with us which frustrated my parents even more. This is when we decided that it would be in my best intentions to just start doing things on my own and stop trying to follow the teachers and proceed to find my own way of learning which had ended up being as simple as going page by page in the text books from the class , instead of trying to learn from listening to the class lectures si nce they were confusing to begin with. This lead to me getting to know the course better since I was studying material that should be essential to the course but was not required to be taught. Having to read and teach myself how to do the work was a big hassle and took up a huge amount of my free time, but was well worth it in the end allowing for me to raise my grades to pass all my classes as well as help with understanding how to complete various assignments in which the other stu dents found themselves lost in . This process continued for many months until I said enough! And recommended to my par ents that I switch to homeschool instead because I was teaching myself anyways and homeschool would allow for me to be in a better learning environment and I didn't have many friends to begin with at the

The Ultimate Fulfillment in Man's Fate  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚   In Man's Fate, Andre Malraux examines the compelling forces that lead individuals to join a greater cause. Forced into a life of contempt, Ch'en portrays the man of action in the early phases of the Chinese Revolution.   He dedicates himself to the communist cause.   It is something greater than himself, a phenomenal concept that he has fused into.   It is something for which he will give his life.   How did this devotion come about?   A combination of his personality, his interior life, as well as society's influence, molded him into a terrorist. Ch'en is self-destructive; he is controlled by his religion of terrorism and his fascination with death.   He is representative of the dedicated soldier who begins as a "sacrificial priest" (4) and ends as a martyr.   After all, the ideologies of communism and terrorism were practically a religion to those involved in the revolution.    An examination of Ch'en's past gives us an idea of how he formed his beliefs, and fell into a state of isolation.   At an early age, his parents were murdered in the pillage of Kalagan.   In addition, at age twenty-four, his uncle was taken hostage and killed because he couldn't afford the ransom, and with no wife or children he was severed from any attachment to a family. He was practically brought up by pastor Smithson, representative of the thousands of Christians that were present in Shanghai, who gave him his Christian education.   However, "[a]s he was devoid of charity, a religious calling could lead him only to contemplation or the inner life; but he hated contemplation and would only have dreamt of an apostleship, for which precisely his absence of charity disqualified him" (64).  Ã‚   Thus, he was u... ...reams which take possession of us because we give them force, but which we can just as easily deny" (180).   This is further reinforced by Ch'en's idea that   "In the last hour I have felt nothing of what used to weigh on me" (192).   Ch'en is the terrorist for the insurrection. His faith had isolated himself from the world instead of submitting to it.   We have a personal need for connection, Ch'en is isolated until the end, when all differences are subsumed. Communism gives a sense of escaping isolation.   For under this ideology there is a personal connection and a feeling of equality.   It is the ultimate fulfillment to live his idea, and more importantly to die for his cause - a cause that is much greater than the individual.   In the end Ch'en becomes the bomb. Financial Analysis of PepsiCo and Coca Cola

PepsiCo and Coca Cola are two major companies that manufacture beverages. They compete to be the number on manufacturer and distributor of beverages in the world. These two companies are very identifiable in this market and you know them as PepsiCo and Coca Cola. These two companies have undoubtedly dominated the markets worldwide that they both receive universal recognition for their different products. Although, there are many other manufacturers and distributors of beverages these two are the major competitors.Not only do they produce soda drinks, they also produce flavored water, spring water, and some energy drinks. PepsiCo, best known for Pepsi and Coca Cola best known for Coke have great marketing anddue to this they are able to target all income brackets. Their marketing and reasonable prices make iteasy for the people to buy their products in all income brackets. I will be examining both company’s income statements and balance sheets to disclose thefinancial condition of these companies in relation one to another.I will also perform vertical andhorizontal analysis from their annual report of financial data. There are a vast amount of manufacturers and distributors in this market, but Pepsi and Coca-Cola have managed to stay in the number one spot for a couple of decades. These two companies have not only dominated the market domestically they have dominated the worldwide market. They followed a plan that kept them above and beyond the market of soft drinks. They have overcome obstacles that allowed them to manufacture and distribute globally. (The Coca Cola Company, 2009).These companies compete with one another for the same customers. When one company comes up with a product the other company comes out with something very similar to it; this is called the â€Å"follow up strategy,† and while doing so they live the other companies behind dazed and confused, wondering what just happened. (www. PepsiCo. com, 2009). Being successful does not come without a price, both of this companies has had to deal with legal issues, precedents, and politics. These two companies are the best examples on how leadership is the power of influence.They design their product geared towards a certain taste and to appeal to a certain population and make look as though they are subjected to certain ethical and moral practices. Their influence in this market is so powerful that they drive out and shut down any other competitor in this market. I would like for you to keep in mind that all financial data of these companies are shown in millions so if you see a figure of 200 that means 200 million and if you see 5,000 it is in the billions. We will start with a vertical analysis of these companies. The vertical analysis comes from each company’s financial statements.The total assets for each company will be the starting point of this analysis. Coca Cola’s total assets in 2004 were $31,441 and its 2005 total assets were $29,427. Pep siCo’s total assets for 2004 were $27,987 and its total assets for 2005 were $31,727. (Weygandt, Kimmel, & Kieso, 2008). The total asset of each of the figures relates to items from each company’s balance sheet. The cost of sales for PepsiCo during 2004 was $12,674 yielding a ratio percentage of 45. 3% of total assets and for 2005 the cost of sales was $14,167 yielding a ratio percentage of 44. 7% of total assets.Coca-Cola’s cost of sales in 2004 was $7,674 yielding a ratio percentage of 24. 4% of total assets and in 2005it was $8,195 yielding a ratio percentage of 27. 8% of total assets. PepsiCo experienced a 5% increase within a one year span and Coca Cola experienced a 3. 4% increase during the same span. This does not mean that this increase is a positive analysis since the single figure does not reveal whether the increase is a positive measure. A higher cost of sales may not be offset by higher revenues matching or exceeding the increased cost. The next th ing we are going to look at is net income.Pepsi had in 2004 a net income of $4,212 and this yielded a ratio percentage of 15. 1% of total assets and in 2005 their net income was $4,078 yielding a ratio percentage of 13. 2% of their total assets. This is a 1. 9% decrease in their net income between 2004 and 2005 and they also show a decrease in the cost of sales during the same period. Coke on the other hand had a net income of $4,847 in 2004 yielding a ratio percentage of 15. 4% and in2005 their net income was $4,872 yielding a ratio of 16. 6% of their total assets. This shows and an increase of 1. 2% between 2004 and 2005.Although they experienced an increase it is not entirely an offset of their income overall, making this a negative indication for Coca Cola. Now the breakdown of each company’s consolidated balance sheets to compare current assets and current liabilities to their total assets for each year considered. Pepsi’s total current assets in 2004 were $8,639 which yields a ratio percentage of 30. 9% of total assets for that year. Pepsi’s total current assets in 2005 were $10,454 which yields a ratio percentage of 32. 9% of total assets. This shows a 2%increase in current assets.In contrast coca Cola current asset in 2004 were $12,281 yielding a ratio percentage of 39. 1% and in 2005 current asset were $10,250 yielding a ratio percentage of 34. 8%;which show a major decrease in their current assets. Although, there was a significant decrease in their current assets it was accompanied by a decrease in their current liabilities, which would be a positive indication for Coke instead of a negative one. Looking at the horizontal analysis of each company will give us more information. Horizontal analysis is also called â€Å"trend analysis† because of its ability to show financial data compared over a period of time.There are two different formulas that can be employed to teach this information. The first one uses the current yea r amount and subtracts from that the base year amount. The second formula divides the current year amount by the base year amount. The year 2004 is the base year for both companies in this analysis. Pepsi’s total current assets for 2004 were $8,639 and for 2005 were $10,454. In the first Pepsi had an increase of 121. 01% of total current assets; over their 2004 base year figure. The second formula yields a 21. 01% total current assets from the base year. Coke’s total assets in 2004 were$12,281 and $10,250 in 2005.As you can see Coke’s total current assets dropped between 2004 and2005 without performing the formulaic calculations. All the analysis shows that PepsiCo and Coca Cola both experienced lower net profits in 2005than in 2004. They showed an increased operation expenses which resulted in a lower net profit. Both has had a higher operating expense in 2005 than in 2004 and need to modify their operations to reduce their expenses so their profit margins can increase so they will not keep experiencing a decrease in profits. I have analyzed two well-known companies in this paper.These two companies are PepsiCo and Coca Cola. These two companies have been around for a long time and have stormed the market. We have seen in my vertical and horizontal analysis that their financial data reveals somewhat a different picture of each company’s financial status. Dear Parents and Guardians, I would like to start off by welcoming you in to our preschool program. The importance of this letter is to get you involved into the planning of activities the children will be doing and explaining the importance of how play impacts your child’s development. Play is the seed of learning in this age group. Between three years old to about seven years old children should be allowed to play most of their day uninterrupted due to the way the child is interacting with the activity they are doing.While your child is playing they are learning to over come many obstacles in their life what you might not see. The child at play is learning to work in groups with other children and getting along. They learn to share and respect each other. Playing is the highest level of learning a child can do, like writing is for adolescents. Take the children playing in the dramatic play area and playing restaurant, they are learning to listen to what each other wants as t hey ask for it. They are learning to share the food being made in the kitchen, and well was â€Å"eating† the food.They learn to listen by paying for their food and learning to wait their turn. They have to wait to be served as well as for their food. At the sensory table that children are playing with moon sand this week, only about four to about 5 children at a time can play there. They learn to take turns with the toys that are with the moon sand, as well as timings due to having to take turns with other children that would like to play in that same area but there just isn’t enough room. As teachers, teen teachers, babysitters, and parents we can learn so much from watching children play.You learn about the whole child and how you can assist that child. You can see what the child might need help in. If the child has problems talking with other children, you now know you need to work on that child’s speech. A child that doesn’t want to share now you kno w that they child isn’t around a lot of other children most of the time. You can learn everything about a child by just watching them play. You learn about where they come from by the way they interact with others, if they have other children in the family, and you learn how creative the child is. This helps teachers and assistances to much.This helps gage where the children are at developmentally and what areas they need to work on. Allowing children to play most of the day, they learn to problem solve, take turns, share, listen, interact with others and let out energy in a positive way. A child learns so much through play and there day would be arranged around the time they get to play. The child has a sense of control of what is going on in their life when they are at play. The History Of The Liberal Neutrality Politics Essay The question is should all government decisions be made on a neutral basis or is there a point where the government should be able to make a decision that they believe if for the best interest of the individual? This issue is discussed by multiple authors and looked at from different angles. John Stuart Mill discusses his opinion of government authority as it affects an individuals interests in his essay On Liberty. Joseph L. Sax discusses his opinion of government authority as it affects the national parks and individuals different interests within the parks in his book Mountains without Handrails. Both Mill and Sax look at government involvement and decision making in two different ways. One as it applies directly to any interest of an individual and the other as it applies only to an individuals interests in a specific area. The main topic of Mills essay is civil or social liberty. He defines social liberty as the nature and limits of the power which can be legitimately exercised by society over the individual (Mill, 5). Social liberty allows an individual to govern themselves to a certain point. This point is where they potentially could cause harm to others. Once an individual has reached this point, society or the government can step in to prevent harm of another person. Society is neutral in an individuals interests until this point has been reached and they have the authority to interfere with an individuals interest if they deem it harmful to others. This is the idea of the harm principle. Mill says the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others (Mill, 14). In one sense social liberty follows the idea of liberal neutrality but it has a loop hole that allows for some bias decision making by society to protect others. Where society does interfere with an individuals interest it is doing so for the best interest of the rest of society and preventing harm to them. The negative effect of interfering with a single individuals interests is outweighed by protecting one or more individuals from harm that is not necessary for them to endure. All decisions come down to choosing between protecting the interests of an individual or society as a whole. One topic that Mill discusses is the struggle between liberty and authority. Liberty was put in place as means of protection for people from their political rulers. At the time people were born into power and liberty was kind of like a clause if the ruler became a tyrant. Authority is needed to prevent individuals from taking actions that would be morally wrong (causing harm to others). Society then changed and all rulers were no longer born into power, they were chosen to represent the people. The representatives of the people were to represent the best interests of the individuals and this would eliminate the need for some forms of liberty and authority since the people would be need to be protected from their own will. One thing that was over looked was the fact that a single group of representatives cannot accurately represent the entire population, they can only represent the majority and the majority is made up of the individuals who are active in getting their voice heard and does not necessarily represent the entire population. This is the idea of tyranny of the majority. Tyranny of the majority occurs when the majoritys interests are placed above the minoritys interests and causes minorities to be discouraged in getting their opinions heard. This brings society back to the same struggle of liberty and authority and where to draw the line between the two. Individuals want to have the power to so as they please but there should be some guide lines or limits to this power. Mill does not explicitly state what all of these guidelines or limits should be with the exception of causing harm to others. Are more guidelines really needed than that? What is society as a whole just decided to do away with rules, regulations and all types of society authority with the exceptions of something that enforced not doing harm to others and just let an individual decide how they wanted to live their life? This is what libertarians advocate for, liberal neutrality. Having a society with no rules or regulations with only a few minor exceptions, would allow for an individual to focus on their interests and preferences and allow them to achieve their version of the good life since there would be not interferences from society. Having liberties can produce a positive effect in individuals if they are given the opportunity to effectively utilize their liberties. Although Mills essay was published in 1859, the ideas he presents are still currently being discusses such as in Mark Sagoffs Can Environmentalists be Liberals?, Cary Coglianeses Implications of Liberal Neutrality for Environmental Policy and Andrew Vincents Liberalism and the Environment. There is no wrong answer to the struggle between liberty and authority and there is a possibility of multiple right answers for this struggle. Mill discusses liberty in a broad sense, and does not apply it to a specific area of interest but to all areas of interest to an individual. Sax discusses liberty and authority as it directly affects national parks and the individuals who benefit from them. He tries to answer or at least present the different sides of answering the question should the national parks basically be treated as recreational commodities, responding to the demand for development and urban comforts that visitors conventionally bring to them or should they be reserves as temples of nature worship admitting only the faithful? (Sax, 2) Preservationists represent one side of this issue and want national parks to remain undisturbed by human activities. The preference for undisturbed nature and recreation in nature is merely just a matter of taste specific to each individual and no policy will be able to please all parties. One individuals interest and preference for a national park may contradict another individuals interests and preferences, which make it difficult for society to remain neutral n its decision making process. National parks are owned by the public and consist of remote and scenic land in large quantities. Parks were first preserved for the scenery they provided so the average citizen would be able to enjoy them. It was though that the more people who came to the national parks the more support there would be for the future preservation of other parks. People wanted different things from the parks though; some wanted them for sites for picnics and resorts while others wanted them preserved as museums. The parks could potentially provide engagement with nature which provides an opportunity for detachment from the submissiveness, conformity and mass behavior that dogs us in our daily lives; it offers a chance to express distinctiveness and to explore out deeper longings (Sax, 42). The nature within the park has the ability to stimulate reflectiveness and self-understanding. It provides a model of continuity, stability and sustenance, adaption, sustained productivity, diversity and evolutiona ry change. Humans can learn a lot by observing nature and applying it to their lives. If this nature is disturbed then these revelations cannot be observed and applies to other aspects of daily life. The problems of recreation can cause many conflicts in national parks. Recreation can be defined in different ways depending on the individual and can vary from hiking to snowmobiling and from five stat resorts to building your own lean to. A compromise has to be made between the many types of recreation. One possible compromise is to try fully to serve the quantitative demand for conventional recreation and to provide opportunities for all of the different kinds of activities the public wants, but not to assure those opportunities in locations that have a special value for reflective recreation (Sax, 63). There is a demand for different types of recreation including intensive-use activities. A balance has to be determined on what types of recreation can take place where and to what extent do they damage the environment and prevent future usage. Sax described how he believes the national park ought to be. One important note that he makes is to discourage motorized travel within the national parks. He also mentions decreasing crowds and allowing visitors the opportunity to experience the park at their own pace. The problem with some of the ideas that Sax proposes is that there is no easy way to determine how to effectively please each individuals wants from the park. The park service is in a dilemma between too many people wanting to utilize the park and not enough park resources to go around and conflicting interests between multiple parties. Sax recommends dealing with this dilemma by separating the choices that have to be made from each other. This will allow clarity about each decision that is made and how it will impact future decisions made. All decisions made have to bear in mind that the park belongs to all individuals but some forms of activities that consume a lot of the resources for everyone should be avoided so m ore individuals can potential benefit. The parks are there to be utilized by the individuals but individuals attitudes contribute to decisions made directly affect the potential future of the park. A certain level of tolerance is required for all parties to allow for the most effective use of the park and its resources. In Saxs book he looks at the governments role in the preservation of the national parks. The government has the authority to put in place rules and regulations that would limit the activities allowed within the parks. This would interfere with an individuals liberties to make their own decisions to pursue their individual interests and preferences. Saxs opinion is to limit an individuals liberties within national parks and to allow for the government to have the authority to control what happens within the parks. Sax and Mill seem to stand on different sides of liberal neutrality. Mill agrees with liberal neutrality with the exception of causing harm to another individual. Sax disagrees with liberal neutrality and thinks that the government should enforce rules and regulations for the individuals within national parks even if they interfere with an individuals liberties and their versions of the good life. Although Sax is talking about a specific situation were liberty and authority conflict, it can be assumed that Mills argument applies to all aspects of an individuals life including national parks. Assuming both Mill and Sax are focused on national parks and an individuals liberties within the park they are really not all that different. Mill and Sax both want individuals to be able to pursue their interests and preferences within national parks. Mill allows for these interests and preferences to be followed until they will cause direct harm to another individual. Sax allows for these interests and preferences to be followed until they will cause direst harm to the environment and potentially cause indirect harm to other individuals trying to utilize the national parks resources. Sax allows an individual to govern themselves to a certain point and his point is where an individuals actions will potentially cause harm to the environment. Causing harm to the environment will limit the availability of current and future park resources for other individuals to enjoy and could harm them and not allow them to pursue their interest and preferences within the national park. In this sense preservationists and environmentalists are liberals and allow people to do as they please without interference form society until they reach the point of harm. The idea of liberal neutrality centers around being open to different individuals version of the good life and being neutral in the decision making process that will affect an individuals ability to achieve their version of the good life. Mills essay he defines liberty and discusses limiting the authority society has over the individual/ Saxs book focuses more on allowing society to have the authority to interfere with individuals liberties as they pertain to the national parks. Both Mill and Sax present different points about the struggle between liberty and authority, they both agree on the authority to interfere with an individual if they are going to cause harm to something else. Mills version of harm focuses on harm to other individuals while Saxs versions of harm focuses on harm to the environment which is a public good and could cause harm to others if not looked out for.

Historical Background: His name when he was born was Lido, not really Lee. He changed it when he had to go down South for a sales campaign. He thought that the Southerners would like it better if his name was Lee. It worked fairly well too. Anyway, his father was the first person to arrive in America. He arrived in 1902, at the age of 12. His father went back to his birthplace, Italy, and married Antoinette. They came back across the Atlantic. Except this time, his father, Nicola, was an American citizen. They moved to Allentown, Pennsylvania, also where Lee was born and raised. Lee (Lido, I’ll use Lee from now on though.) was born on October 15, 1924. Lee’s father was a sort of philosophical type of person. He always had an important lesson to tell his son. It usually was great advice that just about anyone and everyone could use. His father once said that ‘When times are tough, be in the food business. No matter how tough times get, people still have to eat.à ¢â‚¬â„¢ He was right. He had a hot dog food stand that stayed afloat during all of the depression. Lee was in the Allentown public schools, as a kid. He was an Italian kid in a place full of ‘Pennsylvania Dutch.’ So he was harassed by a lot of kids. He never let it get him down though. His father was always pushing him to be the best. His father was a hard worker and came from a foreign family. Back then, most parents that came from a foreign country always seemed to push their kids to do their best so they can have a better life style than their parents. Lee ended up going to Lehigh for college. He did very well for himself. Before he went to college though, he enlisted in the army. It was around World War II when he did so, of course. But because he had Rheumatic fever when he was a kid , he couldn’t go and fight. The doctors said it was gone. The army said it could come back though. So they rejected his application. He went to Lehigh instead. Ford always took the top student out of the top fifty colleges back then, for a study at Ford. They would get to work at Ford doing just about everything you could do. Lee was one of them invited. He enrolled at Princeton after that. He graduated with a degree in engi... ...no matter what. He thought that spending time with family was far more important than anything else. It’s a good thing to have values like that. He’s an honest hard working man that deserved all the good things he got. He didn’t fold when it looked hopeless at Chrysler, he did everything he could to keep the company alive, and now it’s having more success than it ever has in it’s history of existence. This is a very good book, and I recommend that everyone read this one. It’s got a lot of interesting stuff and advice in it. It also gives great insight into the auto manufacturing business. There are a lot of stereotype’s out there that say a car company tried to kill them. But really, all of the guys that make the cars are driving them themselves. They don’t purposely make bad cars, they drive them and so do their kids, and I don’t think all of them are suicidal maniacs either. I think most of them are sane people. I s ay one thing we need less of in America is blood sucking lawyers. They’re just greedy people that we could do without some of them. I learned that in order to succeed, you must not give up easily. You can’t give up on your dreams until you have put your all into it.

The federal Omnibus Budget Reconciliation Act (OBRA) of 1987

The federal Omnibus Budget Reconciliation Act (OBRA) of 1987; established regulations for nursing homes receiving federal funding that includes reimbursements from Medicare or Medicaid programs. It was signed by President Ronald Reagan, and it was the first major revision to the federal standards for nursing home care since the creation of both Medicare and Medicaid in 1965. This legislation changed the legal expectations of nursing homes and their care. If nursing homes do not comply with these regulations they cannot receive federal reimbursement. By the OBRA regulations nursing homes are not allowed to have working nurse aides for more than four months unless they are certified. In order to keep working longer than that aides need to go through a training and competency program. The nursing home will be responsible to verify that the aide is registered in their state. Under OBRA a nurse aide registry must consist of aides who have completed a nurse aide training and have successfully passed the competency evaluation program. The registry must make available the full name of the person, the date his/her training were completed and all the information of any improper conduct. If the person has not practiced in two years he/she may be removed from the registry. OBRA requires that all nursing facilities keep all employees up to date in their trainings. Annual education requires a minimum of 12 hours of training that specially address any weaknesses or areas of concerns that the group may be having. If the facility holds mentally ill patients the aid needs to be able to show that they have the proper skills to handle situations involving those mentally ill patients. The states can have their own training and competency program, for a program to be approves it must meet OBRA regulations. Such training must have a minimum of 75 hours of training of which 16 need to be supervise practical training hours. There are specific requirements under OBRA for a training curriculum. Students need to learn proper communication skills and interpersonal skills, they need to learn how to control infections, the appropriate emergency procedures, appropriates safety procedures. They need to learn how to be able to help patients be independent and to respect the patient’s rights. Students need to learn the needed nursing skills, such as how to correctly take vital signs and how to identify abnormal changes in a patient. They need to be able to know the needs needed when working with patients with mental health problems, and how to give care to patients for cognitively mpaired patients. Some requirements under OBRA are: * To provide services that will help promote each resident’s quality of life to the fullest capacity * To maintain the dignity and respect each resident deserves * To develop a care plan for each resident * To conduct an accurate assessment of each resident upon admission to the center and at any required interval in regards to his overall health * To prevent any decline in regards to daily activities, that includes the ability to east, using the toilet, bathing and walking. The staff of the facility must provide daily living activity care when necessary * To prevent any pressure sores from developing, and if a patient has a sore, to provide any necessary treatment and services to promote healing of such sores, prevent infection, and to prevent any new sores from developing. * To provide the right care for those residents that have urinary incontinence and if it’s possible to try and restore bladder function. It includes also the use of urinary catheters when appropriate, according to the regulations to prevent any adverse consequences related to the use of them * To prevent any type of accidents, this includes any falls, accidental poisonings or any incident that may cause injuries to the residents * To maintain proper nutrition for residents and to prevent any unnecessary weight loss * To provide the residents with sufficient fluid intake as to prevent any dehydration * To ensure that the resident feel free from any medication errors * To make sure the center has enough nursing staff to take proper care of all the resident’s needs * To make sure that all the residents have the right to choose activities, schedules, and healthcare need and that everything is maintained as it should be * To provide all medication services that appropriately meet the physical and psychological needs for each and every resident * To maintain an accurate, complete, and easily accessible clinical recor d for every resident OBRA became a law because of all the public growing concern with the very poor quality of care in many nursing homes and due to all the concerted advocacy of advocates, consumers, provider associations, and health care professionals. OBRA changed the care and lives of nursing home residents all across America. Many improvements have improved the care planning of the residents in the nursing home system. Book review Essay

Florence Industries, Inc. is a company which provides three entirely different types of products and services through three divisions of the company: consumer products division, industrial products division and professional services. Each division is treated as an entirely different company and the performance evaluation criteria is return on assets in recent years after major shift. Although, the divisions used to be treated as profit centres, this decision meant they are treated more as investment centres. The Company in 2008 & 2009: From the income statement for 2008 and 2009, it is noticed that there is an increase in revenue by 4% and 11% increase in net profit in 2009. From balance sheet for 2008 and 2009 it is noticed that Florence has issued shared and borrowed long term loan in order to invest in project required high asset cost as the company asset has increased by $ 50,460,000 during 2009. The Company has also declared a dividend to equity of $ 12,570,000 during 2009 and keep $ $11,736,000 to meet future expansion and expense of business Issues and Analysis: Rejecting Proposals Just Based On Gross Margin Requirement: CFO Ben Johnson has recently rejected the new product proposal of product development manager of consumer products division Calvin Marone as its estimated return of 13.67%(exhibit 1) per year was less than the 15% minimum gross return % requirement any new investment proposal should generate in order to get approve. The company’s 2007 gross return was 9.3 % and Ben estimated that it should go up easily to 12% and set target for each division to bring new product proposal of more than 15% gross return generating capabilities. Then again, gross return of Company in 2009 after rejecting the Marone’s proposal was 9.4%. Suppose if Marone’s proposal would have been accepted, then the Company 2009 gross return would have been approximately 9.6% (Exhibit 2) which would have been even higher than 2008 gross return of 9.5%. So, rejecting proposals that would have actually been beneficial just based on gross margin estimations seems redundant. Return on Investment Comparatively Low In Terms of Free Cash Flow: As per the balance sheet of Florence, it is noticed that there has been an increase in cash balance of $ 390,000 during the year 2009 as compared to 2008 balance. During 2009, the  Company has generated cash of $ 42,756,000 from operating activities and $ 13,950,000 from finance activities. Further the Company has used cash of $ 56,316,000(Exhibit 3) in investing activities. Company has used its majority of cash flow generated from operational and financing activities in investing activities. However in case of Florence, the free cash flow is less than the amount of investment made by the company in 2009 which indicate that the company is highly dependent on third party finance for expansion. However, the company has taken initiatives to counter this. They have broken down divisions into investment centres as compared to cost centres which will help enhance the performance of the divisions and influence them to get more out of investments made. By converting the divisions in investment units, it become the overall responsibility of division managers to generate the profit to the company not only on the basis of revenue and expense but also on the basis of total asset employed in order to run the division. Same Performance Evaluation Standard for Each Division: There are some negatives that came out of the Investment Center approach. First, it may not be appropriate to use one Gross return performance standard for all divisions of Florence, considering differences in type of service provided, products, operations, risks, and differences in measurement because of asset age. These divisions cannot be compared with the same yardstick. For example, Professional services division does not use much asset so it will be inappropriate to measure its performance on the basis of gross return % (exhibit 4). Also, as division manager of Industrial Products division tried to explain, Consumer Products Division had a lot of old machines in their assets meaning those depreciated assets, whatever return they come up with, are making things look better in terms of return on assets than they are in reality. Moreover, including allocated corporate asset in the computation of gross return figure means that division and division managers are held accountable for costs and assets over which they don’t have any control at all. Recommendations: Have Other Evaluation Criteria Along with Investment Center Approach: The decision to treat divisions as investment center has its benefits. Benefits of this approach include improvement in operational decision making, reduction in cost of corporate administration, increased motivation at  division level, and freeing corporate management up for more effective utilization. However, there are some pitfalls as well. Just having return on assets as decision criteria isn’t enough and they should take other criteria into account. Criteria like Economic Value Added which takes into account costs of financing the capital or even simple Net Profit which judges the division’s profitability as a whole. And, to counter the problem of having too many old machines in the consumer products division compare to other divisions, the company could take out the depreciation and compare to see how it affects ROA as a whole when taken in to account and when not. That should give the company a clearer picture. Developing a Balanced Scorecard: Developing a balance scorecard should go some way to make sure performance evaluation is fair and is illustrative of actual performance as it takes into account different measures for different functions usually. In this case, Florence would of course has to make it about the divisions rather than functions of business. In the suggested balanced scorecard below (Figure-1) we can see a bit modified targets and measures for different divisions as their goals are slightly different. Figure-1 For both consumer products and industrial products divisions, returns based on both net profit and ROA are important and give a fairer comparison. Customer satisfaction (in Industrial products division’s case it’s more the satisfaction based on compliance with specific designs is another evaluation criteria for both and the target for both should be bettering last year’s performance in each measures. For the professional services division, the growth has been rapid in recent years and retaining that growth will be important. Another important measure is corporate social responsibility i.e. environmental impact studies the division performs which not only is required by the law but also helps build reputation for the company and is part of CSR activities. So, it’s important to keep that into context. Develop evaluation criteria for new projects: Florence Industries Inc. needs to change evaluation criteria for new projects as it is noticed they’re rej ected a project that would have been beneficial for them every which way just because it didn’t fulfil ROA requirement. Along with ROA, CFO Ben could also analyse the below mentioned points before accepting or rejecting any new project: 1)Project payback period 2)Project NPV (Net present value) 3)Project IRR (Internal rate of return) Conclusion: Florence’s sales growth has been phenomenal for a new company and now it’s time to make some major managerial decisions that will shape the future. And, they have started doing so by transforming the divisions into investment centers from profit centers. While it is a good way to go, creating a balance is necessity and having a more comprehensive knowledge about how every division is doing based on more than one evaluation criteria will be important. Each division is run in their own way and the dissimilarities are far greater to just keep evaluating them based on the investment approach. Also, they can’t keep rejecting projects based on one simple requirement as it hinders the growth of the company. That’s why we suggest Florence Industries Inc. to be a bit more open-minded and take broader aspects in consideration and make things fairer for the divisions and the upcoming projects as well.

Law of supply is a microeconomic law stating that, all other factors being equal, as the price of a good or service increases, the quantity of goods or services offered by suppliers’ increases and vice versa. Law of demand is a microeconomic law that states that, all other factors being equal, as the price of a good or service increases, consumer demand for the good or service will decrease and vice versa. Some of the factors for the change in demand are the tastes, customs, and preferences of the target market, the consumers income level, the quality of the goods or services being offered, and the availability of competitors goods or services. The law of demand states that, in general, price and quantity demanded in a given market are inversely related. In other words, the higher the price of a product, the less of it people would be able and willing to buy of it (other things unchanged). As the price of a commodity rises, overall purchasing power decreases (the income eff ect) and consumers move toward relatively less expensive goods (the substitution effect). Other factors can also affect demand; for example an increase in income will shift the demand curve outward relative to the origin, as in the figure. Some of the factors for the change in supply are production capacity, production costs (including wages, interest charges, and raw materials costs), and the number of other businesses engaged in providing the goods or services in question. The theory of demand and supply is an organizing principle to explain prices and quantities of goods sold and changes thereof in a market economy. In terms of market share, Red Bull leads the energy drink segments, respectively. The energy drink craze has now leaked into the night life crowd. There are many adult beverages that contain energy drinks and the energy drinks not only make a tasty drink, it also give you extra energy to be able to party until the bar closes down. Bar owners are taking advantage of this trend by charging an obscene amount of money to mix alcohol with the energy drink.
